The Public Procurement (Agreement on Government Procurement) (Amendment) Regulations 2021

The Public Procurement (Agreement on Government Procurement) (Amendment) Regulations 2021 (SI 2021/573) (GPAR 2021) have been published and will come into force on 11 June 2021.

One of our legal framework providers, Hempsons has highlighted that a significant amendment is that Foundation Trusts will now fall within the definition of Central Government Authorities and will need to apply to lower financial thresholds for PCR 2015. The threshold from 16 August 2021 will be £122,976, rather than £189,330.

The amendment also clarifies that the UK has acceded to the Agreement on Government Procurement (GPA) in its own right, and to update the obligations upon UK contracting authorities in respect of international agreements (which previously the UK was bound by virtue of being a member of the EU).
