The Health Care Services (Provider Selection Regime) Regulations 2023 laid before Parliament:
On October 19th 2023 the PSR was laid before parliament with the intention that the Regulations will come into force on 1 January 2024. NHS England have provided a PSR toolkit to support the implementation of the PSR, as well as draft statutory guidance which can be found here. They are also providing knowledge drops and practitioner workshops over the next couple of months which you can register for here.
The aim of the new regulations is to move away from the expectation of tendering for healthcare services in all circumstances and towards collaboration across the health and care system. This is intended to remove unnecessary tendering, remove barriers to integrating care and promote the development of stable collaborations. The PSR will still require organisations to comply with processes which evidence decision-making, such as record keeping and publicising notices. Competitive tendering will also remain an important tool for organisations to use when it is of benefit.
