Building Safety Act live from 28 April 2022

The Building Safety Act 2022 regulations went live on 28th April 2022.

The government have published a Dutyholders: factsheet which outlines how it will hold all those involved in construction projects to account, including clients, designs and contractors.
It is right that those who commission building work and who participate in the designer and construction process take responsibility for ensuring that buildings are safe and compliant with the relevant regulations, thereby ensuring that residents are safe, and feel safe.[…] We will use powers within the Building Safety Bill to make new regulations that place duties on those who procure, plan, manage and undertake building work ”

Secondary legislation regulations are anticipated over the next 18months as part of a phased implementation. ‘Higher risk buildings’ have specific focus within the Act, and this will affect the NHS where hospitals meet the height thresholds (at least 18m. 7 stories and have at least two residential units).

An article by Clyde and Co, a NHSCS legal framework supplier, highlights some of the changes that will need to be made, including upskilling of inhouse project management staff.
