Provider Selection Regime: supplementary consultation outcome

On 13th July 2023, DHSC published the consultation outcome on the Provider Selection Regime (PSR), a proposed new set of rules replacing the existing procurement rules for arranging healthcare services in England.

One of the outcomes is that the DHSC and NHSE are looking to set up an independent panel to look at and advise on compliance with the PSR regulations. We are expecting further details around this, including the powers of the panel, to be provided in due course.

Although the consultation has now concluded, there is still no clear date as to when it will be implemented. Until the new regime is in place, previous competition legislation will still apply.
