Procurement Law Obligations from 1 January 2021

27/11/2020

The transition period is currently due to expire on 31 December 2020. The Public Contracts Regulations 2015 will continue to apply, however these will be amended by the Public Procurement (Amendment etc) (EU Exit) Regulations 2020.

Amendments include:

  • Notices will need to be published in the UK e-notification service called Find a Tender instead of the OJEU
  • Where a notice started before the transition period, notices will still need to published in the OJEU.
  • Relevant thresholds will be provided in sterling and will be reviewed every 2 years.
  • References to ‘Europe’ will be removed.
  • PCR 15 (as amended) and the National Health Service (Procurement Patient Choice and Competition) (No. 2) Regulations 2013 will continue to apply to healthcare commissioning, however consultations are expected that will build on previous NHS recommendations to remove the two currently procurement regimes applicable to clinical healthcare services and replace them with a new procurement regime.

Further details are available in our legal provider Hempsons briefing, and in the new amended regulations.
