The next in our NHS Commercial Solutions’ Legal series, begins at 11am 27th of September and will be on - New Trends in IT & Outsourcing Projects – how emerging technologies give rise to new risks, issues and challenges in contracting with suppliers, and what NHS customers can do to protect themselves
The emergence of new, game-changing technologies is radically changing the IT and outsourcing market and how NHS customers go about procuring and contracting for these services. From Artificial Intelligence and Robotic Process Automation, to the use of Agile Methodologies and deployment of Cloud and Digital tools, NHS customers and their suppliers need to prepare for the future.
We will be joined by Chris Holder and Vik Khurana – both IT & Digital Partners at Bristows LLP. They will discuss the impact of these trends on traditional outsourcing models and contracts, focusing on what NHS customers need to consider, including:
• contracting models and the sourcing process – how new tech-based solutions might not fit with the traditional long-form sourcing contract;
• contracting for agile development – the pitfalls that can arise when adopting a collaborative agile-based development approach, and how to mitigate risks in the contract while retaining a co-operative process;
• liability regimes – risks arising from automation can be radically different from those caused by human error; from the nature of losses to the speed and level of liability accrual, the session will look at how to ensure the liability clause protects you on new tech deals;
• data protection – NHS customers are increasingly outsourcing data-heavy internal functions, while also looking to get better quality insights from their data – with real-world privacy and security implications; and
• intellectual property – how to design, deploy and protect key IP assets in a complex world of customer data, aggregation, machine learning and algorithmic improvement.
Chris is an experienced commercial IT lawyer who was one of the first specialist IT outsourcing lawyers in the UK and one of the first to recognise the significance of AI and robotics for the future development of technology and the law. Vik specialises in all aspects of commercial technology law and regularly leads complex and strategic technology projects. In particular, Vik advises on outsourcing, software development and licensing, digital transformation, cloud computing, e-commerce, and other arrangements involving the use or exploitation of IP and technology.
