Data Protection Requirements

The disposal of media that holds data is considered to be 'data processing' under the Data Protection Act, and therefore all Trusts need to be put a number of provisions in place:

  • You must choose a IT disposal supplier who provides sufficient guarantees about its security measures to protect the data it is processing.
  • You must take reasonable steps to ensure those measures are in place, and have a written contract setting out what the IT disposal supplier is allowed to do with the data.

  • Assurance that all appointed suppliers have demonstrated their ability to meet data protection standards, and have agreed to the terms and conditions of the framework agreement, and the terms of call-off contracts under the agreement.  
  • Legal Compliance and reduced procurement timescales. This framework provides Trusts with a legally compliant route to market, with significantly reduced procurement timescales and access to cost-effective and quality-approved suppliers.

Framework Structure

The framework agreement is available to all member organisations of NHS Commercial Solutions and any other public sector organisation to whom NHS Commercial Solutions grants access. The framework agreement has been structured to incorporate two lots:

  • Lot 1 provides for the on-site destruction of data and the removal of the remaining hardware for recycling and disposal in accordance with statutory regulations and the Statement of Requirements. This lot would typically be used where the trust has no wish to obtain revenue from the remarketing of cleansed equipment. For example, where hard drives have been removed from equipment, this lot would be the only viable option as the hard drive would, in all likelihood, be erased and/or shredded.

Under this lot, equipment will be dismantled and all components recycled to prescribed environmental standards.

  • Lot 2 provides for the on-site erasure of data and the removal of the remaining hardware for refurbishment and resale in accordance with statutory regulations and the Statement of Requirements. This lot would typically be used in situations where the trust has complete devices to dispose of and wishes to obtain revenue from remarketing or make equipment available for re-use. Under this lot the data is securely erased from the hard drive, all client-specific markings removed, and the equipment tested and prepared for resale. The trust will receive a percentage of the resale value from the supplier.
